General Terms and Conditions
§ 1 Scope and Subject Matter
These GTC govern the use of the Botsfabrik platform. Botsfabrik grants the customer a non-exclusive, non-transferable license to use the platform according to the selected package (Starter, Intelligent, Premium). Botsfabrik guarantees an availability of 99.5% per month, excluding maintenance periods.
§ 2 Services and Availability
Botsfabrik provides AI-based chatbot and automation solutions. The scope of functions depends on the booked package. Third-party services (e.g. WhatsApp, Meta) are beyond Botsfabrik's control.
§ 3 Contract Duration and Termination
The contract has a term of 12 months. It automatically renews for another 12 months unless terminated in writing 3 months before the end of the contract term. In case of early termination by the customer, the obligation to pay for the remaining term remains.
§ 4 Prices, Payment Terms and Default
Prices are exclusive of applicable taxes. Payments are made monthly or annually in advance and are due by the 10th of the month. In case of payment default beyond the 10th day, access to the service will be automatically suspended. Statutory default interest may apply.
§ 5 Rights of Use and Intellectual Property
All rights to the Botsfabrik platform, including source code and design, remain with Botsfabrik. The customer is granted only a right of use. The customer retains all rights to their own data.
§ 6 Data Protection and Confidentiality
The customer is responsible for data processing; Botsfabrik acts as a processor in accordance with Law 09-08 (Morocco). Botsfabrik commits to confidentiality and takes technical measures to protect the data. Data is only disclosed to third parties upon judicial order.
§ 7 Liability and Warranty
Botsfabrik's liability is limited to direct damages. Liability for indirect damages, lost profits, or failures caused by third parties (e.g., WhatsApp outages) is excluded. The maximum liability is capped at the payments of the last 6 months.
§ 8 Applicable Law and Jurisdiction
The law of the Kingdom of Morocco applies. In case of disputes, the parties commit to an attempt at mediation (30 days). If this fails, the exclusive place of jurisdiction is the registered office of Botsfabrik (Morocco).
